Riforma in materia di tutela dei prodotti alimentari

Il 29 maggio 2026 è entrata in vigore la Legge 21 aprile 2026, n. 75, recante “Disposizioni sanzionatorie a tutela dei prodotti alimentari italiani”, che si propone di rafforzare la tutela della qualità, autenticità e sicurezza dei prodotti agroalimentari italiani (riconosciuti come asset strategico nazionale), intervenendo in modo coordinato lungo tre direttrici: penale, amministrativa e controllo della filiera.

  1. LE MODIFICHE ALL’IMPIANTO PENALE

Il cuore della riforma risiede nella modifica del Titolo VIII, Libro II del Codice penale, ora rubricato “Dei delitti contro l’economia pubblica, l’industria, il commercio e il patrimonio agroalimentare”, dove è stato inserito il nuovo Capo II-bis, specificamente dedicato ai delitti contro il patrimonio agroalimentare e incentrato sulle seguenti tre fattispecie di reato:

  1. Modifica dell’attuale reato di “Contraffazione dei segni di indicazione geografica e di denominazione protetta dei prodotti agroalimentari” (art. 517-quater c.p.): la riforma ha inasprito il trattamento sanzionatorio di questa preesistente fattispecie (reclusione da uno a quattro anni) e ha esteso la relativa tutela anche alle fasi di deposito doganale e custodia temporanea delle merci. 
  2. Nuovo reato di “Frode alimentare” (art. 517-sexies c.p.): sanziona chiunque, al fine di trarne profitto, nell’esercizio di attività economica, importa, esporta, spedisce in transito, introduce in custodia temporanea o in deposito doganale, trasporta, pone in vendita, distribuisce o mette altrimenti in circolazione, acque o bevande non genuini o sostanzialmente difformi per origine, provenienza, qualità o quantità rispetto a quanto dichiara. La sanzione prevista è la reclusione da due mesi a un anno e multa da euro 1.000 a euro 4.000.
  3. Nuovo reato di “Commercio di alimenti con segni mendaci” (art. 517-septies c.p.): sanziona l’uso di indicazioni false o ingannevoli su origine, qualità o quantità. La norma include espressamente il commercio tramite piattaforme online e strumenti digitali. La previsione prevede la reclusione da tre a diciotto mesi e multa fino a euro 20.000.

Per tutte queste ipotesi sono previste circostanze attenuanti (art. 517-quinquies c.p.: supporto alle autorità di polizia o giudiziarie per contrastare i delitti; raccolta di elementi decisivi per la ricostruzione dei fatti, l’individuazione o la cattura dei concorrenti negli stessi o l’individuazione degli strumenti occorrenti per la commissione dei delitti o dei profitti da essi derivanti) e circostanze aggravanti (art. 517-octies c.p.: le condotte attengono alla denominazione di origine o all’indicazione geografica degli alimenti o degli ingredienti protette dalle norme vigenti; i fatti sono commessi mediante falsi documenti di trasporto o false dichiarazioni all’organismo di vigilanza; i fatti sono di particolare gravità in ragione della quantità dell’alimento oggetto dell’illecito; le condotte hanno ad oggetto alimenti indicati come biologici in assenza della relativa certificazione; le condotte sono realizzate con più operazioni e attraverso l’allestimento di mezzi e attività continuative organizzate, c.d. agropirateria).

Per tutte queste ipotesi, inoltre, opera la confisca obbligatoria e per equivalente (art. 518 c.p.).

Per le ipotesi sub B e C, se il fatto è particolarmente grave o si tratta di recidiva, il giudice può disporre la chiusura temporanea, da cinque giorni a tre mesi, dell’esercizio.

Il Legislatore ha altresì previsto che le ipotesi di “Contraffazione dei segni di indicazione geografica e di denominazione protetta dei prodotti agroalimentari” (art. 517-quater c.p.) e la sola forma aggravata di “agropirateria” (art. 517-octies, quarto comma) configurino una responsabilità d’impresa ai sensi dell’art. 25-bis.1 del D.lgs. 231/2001.

Numerose previsioni incidono poi sugli istituti del procedimento penale: (i) ampliando i poteri di indagine in tema di ispezioni senza preavviso finalizzate al campionamento e di intercettazioni; (ii) estendendo l’ambito di applicazione dell’incidente probatorio anche alle attività di analisi su alimenti deteriorabili; (iii) prevedendo la destinazione a scopi benefici degli alimenti sequestrati e confiscati.

2. LE MODIFICHE ALL’IMPIANTO AMMINISTRATIVO

    La riforma apporta numerose modifiche alla disciplina delle sanzioni amministrative, rimodulandole con un importo variabile tra un minimo e un massimo edittale che tenga conto della gravità del fatto, della durata della violazione, dell’opera svolta dall’agente per l’eliminazione o l’attenuazione delle conseguenze della violazione e delle condizioni economiche dell’agente. Tali modifiche hanno interessato le seguenti materie:

    • DOP e IGP agroalimentari e vitivinicole;
    • Rintracciabilità;
    • Informazioni ai consumatori;
    • Denominazioni del latte e dei prodotti lattiero-caseari;
    • Contributi della PAC per il settore vitivinicolo e dell’apicoltura;
    • Centri di Assistenza Agricola che svolgono attività a favore delle imprese agricole;
    • Pesca marittima.

    3. LE MODIFICHE CONCERNENTI I CONTROLLI SULLA FILIERA

      La riforma interviene, infine, in materia di controlli sulla filiera alimentare, modificando:

      • la disciplina dei contrassegni per la tracciabilità dei prodotti DOP e IGP;
      • il regime di tracciabilità per i prodotti della filiera bufalina e lo strumento di pianificazione dei relativi controlli; 
      • l’istituzione del “blocco ufficiale” temporaneo; 
      • la formalizzazione della Cabina di regia per il coordinamento dei controlli; 
      • l’assegnazione ad Agecontrol dei controlli sulle imprese agricole in ambito PAC, in merito al rispetto della clausola di condizionalità sociale. 

      4. CONCLUSIONI

        Alla luce di questa importante novità normativa, le imprese agroalimentari sono chiamate ad aggiornare le proprie procedure interne relative ai controlli sulla filiera e ad aggiornare i propri Modelli ex D.lgs. 231/01 al fine di ridurre il rischio connesso all’applicazione del nuovo regime sanzionatorio appena entrato in vigore.

        Senior Associate

        Tom Noad is an English solicitor specializing in international trade and corporate law.

        He assists Italian and foreign companies in negotiating cross-border contracts and extraordinary transactions in all commercial and industrial sectors.

        Viorica Efros specializes in corporate and commercial law and has extensive experience in M&A transactions, JV agreements, corporate governance, as well as international commercial contracts (agency, distribution, supply, consulting, procurement, etc.), retail, and real estate.

        He provides advice on commercial contracts (joint ventures, distribution, agency, sale and purchase, procurement, etc.) and public subsidies in the agricultural sector.

        He has gained extensive experience in the wine and agri-food sectors.

        He is a member of the Association Internationale des Juristes du Droit de la Vigne et du Vin (International Wine Law Association) and holds a sommelier diploma.

        He serves as an advisor to several wine consortiums.

        Co-founder in 2018 of L2B Partners – Law Firm (merged into Indaco in 2026), he previously worked for Withers and CBA.

        He graduated in Law in Verona and is a member of the Padua Bar Association.

        He speaks Italian, English, German, and Spanish.
